Leadership


My view on leadership @ 16.5.2014

Just like to share some of my thoughts on leadership and organisation. Let me confess upfront: I don’t know much about these two difficult subjects. Just my two cents.
  1. Leaders should never think or say that they have done or sacrificed a lot for the organisation. It is their choice to be in leadership position and thus is expected of them. It is for the other members to remind yet others of their hard work and sacrifice.
  2. When leaders demand trust from members - trust their judgment, integrity and wisdom, it may be the beginning of trouble. They stop to reason or rationalise with members on issues. They want blind followers.
  3. The other way of looking at it is this. When they ask members to trust them, implied message is that “we don't trust you. Therefore we don't want to share too much information with you. We doubt your intellectual capacity to comprehend or you may share the information with third parties.” Members may submit to the demand, not out of respect, but out of fear, fear of being reprimanded in the open. Fear of leaders throwing tantrum.
  4. While we may trust our leaders, we also want transparency and accountability. We also want our “right to know” to be respected.
  5. Dissent within an organisation is healthy and to be encouraged. Leaders should respect dissenting views and use their power of persuasion to get the minority to see their point and get their support. Someone once said, “When two persons always agree, one is unnecessary.”
  6. Constitution is the supreme law of any organisation and is to be followed strictly. Of course it may be amended but until this is done, the provisions are the law governing the organisation. Executive may have power to interpret but they cannot choose not to follow.
  7. Do the right things right. Seek to do what is right, not what is convenient.

15. 政府钱多多,到处养白象。
16. 到处在建屋,建好却空着。
17. 有人宣佈要作乱,不见警察捉。
18. 有人丢氣球,被告伤人。

往事1981

中一那年,我们一行六人骑脚车去硝山露營。好心的膠工告诉我们營地附近有老虎出没,还带我们去溪边看老虎的足印,说他看到老虎涉水去对岸了。

我们那时艺高人胆大(少小不更事),只把扎營地点往下移一些,營地大概比溪水位高十几尺。忘了是恃着人多,还是以为老虎笨,只能在某一特定范围内移动。

当天中午我们在小溪游泳。下午一两点开始下雨,越下越大。我们冒雨在帐篷四周挖沟、杀蜈蚣、探水位。水越涨越高,我们也越来越紧张。

到傍晚时,探子报说水位涨到离營地两三尺,我们决定撤退。把帐篷打包,要绑在树上,平常很 pandai爬树的良福脚软,需要我们把他推上去。绑好后要逃时突然发现少了一人,喊了一阵才发现他已骑脚车先逃了。

到了镇上,不巧的是高佬和宗亮都不在家,还好我有一位女同学住在硝山,好心的伯父母让我们借宿一宵。当晚红仔还得去买拖鞋,逃难时掉了。

隔天一早我们趕紧去收回帐篷,不见了可要赔给童军团。

1980年代的丽士戏院

1980年代的丽士戏院真是卧虎藏龙,常"听到"有人打架,我亲眼看到的只有一两次。 

我家前面的面档是卖早歺与宵夜的,有一阵子下午有外人进驻,卖别的"物品"。他把物品丢在草叢,顧客付钱后,他就去捡起物品交货。 有一次他走过我家,掉了一包在地上,我那时少不更事,走去想拾起给他,被大人制止,说不可以碰,他不久就会回头来找,果不其然。

丽士戏院是我们的遊乐场,玩的遊戏现今的孩子们是不懂或不玩的: 

*捉迷藏
*单脚跳
*吃肉 - 拿乒乓球丢人,当年有个小胖的腿是我们的最爱。
*踢球 - 把旧报纸捏成一圆球装在塑膠袋,然后用塑膠圈圈起来。曾经踢破厕所的玻璃窗,马上作鸟兽散。
*搶鞋 - 用粉笔在地上划一圆圈,然后把大家的鞋放进去,其中一人去掌鞋,其他人负责把鞋搶出圈外。
* Bena - 马六甲人叫 Hantu Galah.

崇华的动物園

回到江沙,想起从前崇华有一间动物園,养着骆驼、大象、豹、公鸡、母鸡、凤、蛇、蚱蜢、还有几只豬。

並且种有蕃薯、蒜头及黄䔧。当然,动物是养的,植物是野生的,不然种蒜头与黄䔧给那几头动物吃。

而今蚱蜢跳到英国、蛇行至新加坡、凤飞飞到澳洲、骆驼走上云顶、豹影无踪、蒜头移植到关丹、动物園管理人在马六甲。

毕业后,各奔东西,如今已是30年了。

五月五

1969
家,在九条沟。
屋外,巴冷刀或置于我家门口,或持于手中。
衆声呐喊:「Balik Tiongsan!」。
屋内,人心惶惶, 离家,是唯一选择。

还是1969,
家, 在四条港。
村内,战战兢兢的过生活,草木皆兵。
村㚈,时有风吹草动,全村人马上跳上各自的漁船,
或到海中央,或到无人的灌木林躲着,
直到探子回报:回家了,回来吧。
回家, 是无奈的喜悦。

2012
家,在古城。
城外,Balik China, Balik India 仍时有所闻。
城内 ,遊客络绎不绝。
时代进步, 可以 pergi Cuba, Argentina, Libya
选择多了,悲哀依旧。

2013
家,还在古城。
州内,烽火连天。
州外,势均力敌。
这边厢,五月五,换政府。
那边廂,要改变,不换政府也可以。

现在,一切归于平静。

1. Prepare for appeal at the High Court trial - when the Fiat major ruling is made against you.

2. Leave - set out chronology, set out whole story. Short paragraphs

3. Exhibit record of appeal

4. Must not assume judges read papers

5. Take the best point first.

6. Don't assume judges know the law.

7. If appeal is against part of decision, describe very clearly in 1 sentence.

8. Memo of appeal - list of complaints against judge - don't draft too specifically. Draft in broad ways, then go into specifics.

9. Now: memo filed without benefit of grounds of judgment and reserves right to raise new grounds.

10. Prepare only outline of submissions.

11. Submissions - take the best point.

12. Do it in style.

To reduce corruption - just get civil servants and corporates to sign pledge.
Better still, get everyone who needs to deal with civil servants to sign it. 

To improve exam results - just set easier questions and lower the passing marks.
 Better still, make it so low that we have thousands of straight A students.

1.         Preparing for trial - be guided by chronology of events:
a)               No point for partners to keep asking for chronology.
b)               Lawyers must find it useful.
c)               Why chronology – old and complicated files: format, additions, rewrite.
d)               Avoid risk of overlooking something.
e)               Everything is at fingertips - impress the judge.
f)          Source of documents, date, event/documents, comment – conflicts, inconsistencies, gaps in information etc, exhibit number.
g)               Update regularly.
2.       Drafting agreed facts - refer to COE.
3.       Drafting issues - read pleadings and submissions filed in LC, HC, COA for earlier proceedings: SJ, striking out etc to identify issues.
4.       Bundle of documents – practice note No. 1 of 1969 and No. 3 of 1970:
a)               Document and attachment should be treated as 1 document.
b)               If in doubt, put in part C: non-agreed.
c)               Notice To Produce – s66 of Evidence Act.
5.         Witness statement:
a)      In witness own words. No finalising WS without seeing witness.  Gauge level of education or experience – bankers, businessman, dispatch boy etc.
b)               Don’t copy statements from pleadings. Facts but in legal terms vs giving evidence.
c)        Avoid difficult or uncommon legal terms - negligence, breach of duty, fundamental beach.
i)          Sindutch Cable v LTB Power.
d)               Get first response and ask further questions. Treat like real trial but simplify.
e)          No leading questions unless sure that there will be no objection from opponent. E.g. agreed facts.
i)          Formosa Resort Management v MBB
f)                Don't cut and paste from other WS without amendment. No 2 persons use exact same words to describe same event.
i)          Impression Concept Interiors v Profil Makmur
ii)          Lim Kee Bak Kut Teh
g)               Way to introduce documents. Take care of weight.
h)           Evidence from recollection of old events cf evidence from reading documents. Don’t ask: please see pages ... and ... of CBOD, what is this document?
i)                 Don't state “I will answer/tell in Court”. No matter how difficult or long the answer is.

6.         Preparing witness for trial:
a)       Witnesses like to compare practice of Malaysian court with court in their own countries. “If you want to win your case, come to our Court and play by its rules”.
b)      Tell witness: Forget about what you have just said in court. Focus on the next question. It is more important.
7.         Presence of witnesses in Court while another witness is giving evidence:
a)               Disclose to Court.
b)               Parties may be present in open court but some judges do not allow.
c)               Companies – representatives.
d)               Expert witnesses may sit in open court - opinion not facts.
7.         Cross exam questions – thorough preparation and visualize.
8.         Note taking:
a)               Important things said in Court: judges' comments; argument on law.
b)               Agreement on documents and to lead witness etc.
c)               Write re-exam questions - practise and learn.
d)               Write down important points for submissions.

4. 在高速行驶的火车上,一个老人不小心把刚买的新鞋从窗口掉了一只,周围的人倍感惋惜,不料老人立即把第二只鞋也从窗口扔了下去。这举动更让人大吃一惊。老人解释说:这一只鞋无论多么昂贵,对我而言已经没有用了,如果有谁能捡到一双鞋子,说不定他还能穿呢! 感悟:注定无法挽回的痛苦,不如早点放弃。

5. 第一天,小白兔去钓鱼,一无所获。第二天,它又去钓鱼,还是如此。第三天它刚到,一条大鱼从河里跳出来,大叫:你要是再敢用胡萝卜当鱼饵,我就扁死你。 感悟:你给的都是你自己“想”给的,而不是对方想要的。

6. 一个朋友是医生,一次癌症手术,打开后发现切不了,只好再缝上。去和病人解释情况,那病人农村来的,听不懂术语,坚持认为手术过了,病就好了。只好让其出院,一年后回访,真好了,癌细胞真消失了。朋友原是医学博士,后来接着读心理学博士去了。 感悟:乐观的心态是最好的手术。

Financialisation

Financialization was one of three megatrends that swept the world in the last thirty years – the others being free markets and globalization. Financialization is defined as the growing importance of finance in daily activities, both at the national and global levels. Kids grow up these days wanting to be financial engineers instead of civil engineers. The effect was massive credit creation and financial turnover in terms of scale, speed and geography, turning finance from an agent of the real sector to a power in its own right. Hence, the solution to unsustainable financialization is not more debt, but more equity or the net worth of real sectors — households, enterprises and the government sector. 梦的颜色

我终于可以确定,我的梦是有颜色的,严格的说,是局部有颜色。

前天梦到我参加公司的旅遊团,到了一个大卖场,我买了一包干捞面,我低头一看,纸袋里的面是黄色的。抬起头一看,卖场里只剩我一人!

梦境转到一条路上,我检到一颗可可果当球踢。可可果是青黄色的。

梦境里的其他物件是没有颜色的,只是当我聚焦于某件物品时,它在现实世界的颜色才会显现出来。

週末,我喜欢待在家里玩电孑遊戏。

公公说:不要整天玩电孑遊戏,跟我到Botanical Park晨运。
妈咪说:听说 Botanical Park最近有攫夺案。不要去。

婆婆说:不要整天玩电孑遊戏,跟我到 Taman MBM 晨走。
爸爸说:我的朋友去那里跳排舞,车镜被砸,钱包被偷。不要去。

爸爸说:那去附近的足球场踢足球吧。
妈咪说:那里离家远,没大人看着,小孩会被捉走,多么危险啊!

妈咪说:就在家门前的篮球场打篮球吧。
爸爸说:我办公室的安娣Jennifer两天前在家门口被打搶。多么可怕啊。

所以,我的週末,还是在家里玩电子遊戏。
我说:大人们,這是多么值得高兴的一件事啊!

週末,我继续待在家里玩电孑遊戏。

週末,我很少待在家里。

一早,我们就在丽士戏院的停脚车场玩单脚、搶鞋、卡通扑克牌、或在欢院里玩捉迷藏。

爸爸说:整天出去玩,也不留在店里帮忙 。

下午,我们就在拿督公神龛旁捉豹虎、或玩弹珠、或到水沟捉孔雀魚。

老师说:有些人考试要到还不读书,跑去捉豹虎。

晚上,我们骑脚车巡街、或到团结局学国语,然后去大排档吃 kosong 面。

婆婆说:不要出到这样夜,你没回来,我都睡不着。

週末,我还是很少待在家里。

On 30.8.2015, my wife and I went to the clock tower at 10 am. There was a group of yellow shirted people there. Police allowed us 5 minutes and asked to disperse after that. All Bersih 4 T-shirts were asked to be turned inside out. I was wearing Bersih 3.0 and was asked to take off.  I argued that it is not Bersih 4 and the inspector didn't insist. We sang Negaraku and dispersed.  The inspector shook my hand and thanked me for being cooperative (did he think that I was the leader or I looked like the leader). He told me he didn't want to arrest anybody though order had been issued. He was friendly and smiling.

Then the crowd gathered again at 11 am and the police asked to disperse immediately. This time the inspector looked very serious. We again sang Negaraku but still hung around.  The policemen lined up at the road and police truck came. My wife and I left after the second warning.  I didn't know the police started arresting people until friends posted.

One police told a friend if he is not on duty, he would like to wear yellow too!
